Representative Callegari introduced HB 87 to curb the regulatory effects of state agency rules. As introduced, HB 87 prohibits a state agency from adopting a rule regulating an occupation that is substantially burdensome and unnecessary to fulfill the purpose and intent of the statute authorizing the regulation. The bill allows an individual to challenge an agency rule that is substantially burdensome and fails to meet a statutory purpose. Over 500 different types of jobs and businesses are regulated by the State of Texas. Examples include interior designers, psychologists, auctioneers, dieticians, and landscape irrigators. Plumbers, accountants, nurses, court reporters and cosmetologists, too, are subject to state oversight.
